The length of time a road traffic claim takes, is entirely dependent upon the injuries and complexities of your case.

A straightforward Road Traffic Accident can take approximately between 6 to 9 months, however it is important to ensure that there is a clear understanding as to what extent the accident has had an impact on you. Each case depends entirely on the individual and their recovery, which can differ for many reasons.

Time frames can also depend upon the defendant accepting liability, and any problems that could arise from this. If liability is disputed, then the claim will take longer as this will need to be resolved.

Road traffic accidents can result in many different types of injuries on a scale of severity. We have many years of experience in fully investigating and gathering all relevant evidence needed to pursue a road traffic accident compensation claim. This can include gathering any additional evidence on your behalf, such as photographs, witness statements and CCTV footage.

For personal injuries suffered, a medical examination will be required in order to assess the extent of injuries and the impact they have had. From this and evidence of other losses, we can calculate the amount of compensation and damages you should receive.

When there is a case for negligence supported by strong evidence, we will negotiate with the other side to secure an admission of liability. Supporting claims with strong irrefutable evidence means that the majority of cases are settled out of court, and there may be opportunity to secure interim payments. These will cover immediate expenses you’ve faced, in order to stop you being out of pocket.

However in cases where an agreement cannot be reached and the defendant disputes the claim against them, we can start litigation to secure a fair compensation settlement for you. Most of our road accident claims are settled out of Court, but in the event that Court proceedings are necessary we will guide and support you through the process.

In the majority of cases, court proceedings must be issued within 3 years of the accident taking place, this is known as the limitation period. We advise that you contact us as soon as possible following your accident.

There are some exemptions from this 3 year time limit, for example the individual being a child or not having mental capacity. We can provide further information of the exceptions to this.

Even if you think you are to blame, it is still worth contacting us as we can talk through the incident. It may be that you are only partially to blame, and liability can be negotiated on a split basis, to help cover costs you’ve faced as a result.
